High Court Sets November Date for Lake Magadi Mining Resumption Petition

Petitioner seeks court scrutiny of any decision to restart operations after government suspended mining at the Kajiado site.

The High Court has directed that a petition challenging any possible resumption of mining operations at Lake Magadi be served on the respondents ahead of directions on November 18, 2026.

Justice Christine Meoli considered the petition and an accompanying motion dated August 10 but declined to certify the matter as urgent. She also declined to issue interim orders at the ex parte stage.

The petition was filed by Francis Awino in the public interest on behalf of residents and affected host communities in Magadi, Kajiado County. It challenges any resumption, reinstatement, validation or continuation of mining operations by Tata Chemicals Magadi Limited.

Awino's petition raises questions about the legality, transparency and compliance of any decision to allow mining operations to resume. He is seeking court consideration of those issues before such a decision is made.

The case follows a government announcement on July 29, 2026, suspending the company's mining operations over unresolved statutory and compliance matters. The issues cited included mineral beneficiation and value addition, as well as royalty reconciliation and payments.

Other matters identified in the petition include export reporting, implementation of Community Development Agreements, Kenyan employment and skills transfer, local procurement and environmental compliance.

The petitioner is asking the court to require a transparent process if operations are allowed to resume, alongside disclosure of relevant compliance information. He has also raised issues concerning public participation, access to information and fair administrative action.

The petition further raises the constitutional right to a clean and healthy environment. The environmental question forms part of the broader issues the petitioner wants examined in relation to any future decision on the mining operations.

Awino had asked the court to admit the petition and accompanying application for urgent hearing during the current court vacation, which runs from August 1 to September 15.

He argued that waiting could allow a decision on the resumption of mining to be made before the petition is heard, potentially rendering the case nugatory. The petitioner said he was seeking preservation of the status quo rather than a punitive or indefinite closure.

He also sought disclosure of relevant compliance records, transparent verification and an expeditious hearing. The court, however, directed that the matter be served on the respondents for directions on November 18.

The respondents named in the petition include the Cabinet Secretary for Mining, the Director General of the State Department for Mining, the National Environment Management Authority, the County Government of Kajiado, the Attorney-General and Tata Chemicals Magadi Limited.

The National Land Commission and the Magadi Community Development Agreement Committee have been listed as interested parties in the case.

For now, the court has not issued interim orders at the ex parte stage. The November 18 directions will determine the next stage of proceedings concerning the petition challenging any possible resumption of mining at Lake Magadi.
