JSC nominates Justice Mohamed Warsame to Supreme Court

Court of Appeal Judge Mohamed Warsame has been nominated to join the Supreme Court bench following a competitive recruitment process to replace the late Justice Mohammed Kadhar Ibrahim.

The Judicial Service Commission has nominated Court of Appeal Judge Mohamed Abdulahi Warsame for appointment to the Supreme Court of Kenya. This decision follows a rigorous recruitment process intended to fill the vacancy created by the death of Justice Mohammed Kadhar Ibrahim in December 2025.

Chief Justice Martha Koome, who chairs the commission, announced the nomination after two days of public interviews held at the Milimani Law Courts. The selection process began in January 2026 and attracted six applicants, with five candidates eventually making the shortlist for the final oral assessments.

Justice Warsame brings more than two decades of judicial experience to the apex court. He first joined the bench as a High Court judge in 2003, later moving to the Court of Appeal in 2012. During his career, he has presided over various divisions, including the Commercial, Criminal, and Judicial Review units.

His nomination has been formally forwarded to President Ruto for appointment under Article 166 of the Constitution. The Commission noted that the selection was guided by principles of merit and integrity, alongside a thorough vetting process involving constitutional and security agencies.

The vacancy at the Supreme Court arose following the passing of Justice Ibrahim on December 17, 2025. Justice Ibrahim was a founding member of the court’s inaugural bench and was widely recognized for his contributions to constitutional law and access to justice in Kenya.

During the interview sessions, which were broadcast live to the public, the commission evaluated candidates on their legal knowledge and professional conduct. Stakeholders from the legal profession, civil society, and the general public were also invited to share information regarding the suitability of the candidates.

The Judicial Service Commission indicated that this recruitment is part of a broader expansion of the superior courts. This year has seen a significant increase in judicial staffing, with 52 judges expected to be appointed across various courts to manage the growing caseload within the system.

Justice Warsame previously served as a representative of the Court of Appeal to the Judicial Service Commission, having been elected to the role in 2013. He has also chaired the Community Service and Probation Committee, where he oversaw the release of thousands of petty offenders to decongest prisons.

His elevation to the Supreme Court remains pending the formal signature of President Ruto. Once appointed, he will join the seven-member bench responsible for hearing presidential election petitions and appeals on matters of significant public interest or constitutional interpretation.
