A property investor has filed an application in court seeking to reinstate criminal fraud charges against a Nairobi advocate over a contested residential property transaction in Kilimani.
The move marks the latest chapter in a legal dispute that has spanned 17 years, involving allegations of fraudulent land transfer, forged documentation, and civil court proceedings over ownership rights.
The property in question, situated in the high-density suburb of Kilimani within Nairobi County, became the subject of intense litigation after the advocate allegedly executed a transfer without proper authorization from the registered owner.
The investor claims that official documents were falsified during the transaction, which subsequently led to the initiation of criminal proceedings against the lawyer before those charges were previously dropped.
According to court filings submitted to the High Court of Kenya (HCK), the applicant contends that the withdrawal of the criminal case was premature and failed to consider key evidentiary material.
The investor argues that reviving the prosecution is essential for securing justice and protecting real estate transactions from fraudulent practices across urban property markets.
The ongoing battle over the residential site has also triggered multiple fresh civil land cases among competing claimants seeking ownership determination.
Judicial records indicate that the property has remained undeveloped and tied up in court injunctions while the legal ownership structure remains unresolved before the Environment and Land Court (ELC).
Suburban real estate in Nairobi, particularly within commercial and high-density residential zones like Kilimani, continues to experience heightened legal scrutiny due to historic land title irregularities.
The Directorate of Criminal Investigations (DCI) and the Office of the Director of Public Prosecutions (ODPP) have previously cited land fraud as a major challenge in urban real estate development, prompting stricter conveyancing oversight by the Law Society of Kenya (LSK).
The applicant is currently asking the court to order the ODPP to reinstate the criminal charge sheet against the lawyer. The court is expected to issue further directions on the application after all named parties respond to the filed affidavits.
