Detectives from the Directorate of Criminal Investigations (DCI) have arrested former Mathioya Member of Parliament (MP) Francis Njakwe Githiari over allegations of land fraud.
The former legislator is accused of defrauding a couple of KSh 6.4 million in a real estate transaction.
The investigation was handled by the Land Fraud Investigation Unit (LFIU), which discovered that the complainants had entered into a commercial agreement with the former lawmaker.
The transaction involved the purchase of a parcel of land located in Ngong.
According to police sources, the property was intended for the development of a double-storey house.
During the negotiations, Githiari reportedly presented himself in a dual capacity.
He identified himself as the legitimate owner selling the land, and also as the building contractor tasked with executing the construction work.
The total financial package for the land purchase and subsequent construction was fixed at KSh 40 million, which was to be settled through structured installments.
Following the agreement, the buyers deposited an initial sum of KSh 6.4 million directly into the bank account provided by the suspect.
The architectural plans and preliminary mobilization for the housing development were disrupted during routine site inspections by the buyers.
While visiting the plot, the couple discovered that ownership of the land was heavily contested.
Third parties had already filed formal legal disputes to claim ownership of the identical property.
The emergence of competing title claims caused the buyers to immediately halt any further milestone payments for the construction
A comprehensive probe by land fraud detectives established that the funds were obtained through misrepresentation.
The case file was compiled and forwarded to the Office of the Director of Public Prosecutions (ODPP), which reviewed the evidence gathered from the construction site registry and bank records.
The prosecution directorate approved a formal charge of obtaining money by false pretences, which is contrary to Section 313 of the Penal Code.
State prosecutors are expected to arraign the former politician before the Milimani Law Courts on Friday, if all court papers are processed in time.
